Woman faces felony DWI for driving with child

A 39 year-old woman from New York is awaiting trial for a felony DWI conviction she received last week after officers pulled her over for drunk driving and found her 2 year-old daughter in the back seat. The woman was pulled over for swerving across yellow lines several times, driving nearly 20 mph below the speed limit, and stopping at a stop light for two cycles. Once pulled over, officers administered several field sobriety tests and a breath test, which showed she had a blood alcohol content more than three times over the legal limit.

Driving drunk with a passenger younger than 16 years-old is a felony offense under Leandra’s Law. The law is named after an 11 year-old girl who was killed in a drunk driving accident caused by her friend’s mother who was driving them to a sleepover.
