Raleigh man’s drug conviction upheld in appeals court

Posted on May 8th, 2012 No Comments

A 39 year-old Raleigh man’s appeal lost his appeal in court this week after he claimed that the evidence taken from his car was illegal because officers did not have a search warrant. He also argued there was no reason for authorities to believe he was carrying narcotics.

However, Graham County officers found hundreds of prescription narcotics hidden under his seat. According to court documents, the Raleigh man was pulled over after making a sudden lane change without signalling. A drug sniffing dog prompted the officers to search the car.

The Appeals Court decided that authorities had reasonable suspicion to stop and search his vehicle and upheld his drug conviction.
