DWI Penalties

The types of penalties that are associated with DWI convictions in North Carolina primarily depend on the circumstances surrounding the arrest and the driving history of the accused individual. Some of the specific penalties include:

First Offense

  • Up to $2,000 of fiscal penalties
  • One day to two years spent in jail
  • Up to 24 hours of cumulative community service

Second Offense

  • Driver’s license will be revoked for up to four years if the DWI takes place within 36 months of the first offense
  • $1,000 in potential fines
  • Seven to twelve months jail time
  • The driver will become ineligible to receive limited driving privileges if the second offense takes place within seven years of the original DWI charge

Third Offense

  • The driver will lose their driver’s license permanently if they have any previous DWI convictions on record within the past five years.
  • $2,000 in potential fines
  • Range of one week to two years of incarceration

Fourth Offense

  • After the fourth offense, the driver may be facing felony charges if the three previous DWI convictions have occurred in the last seven years.
  • Minimum of twelve months and a maximum of three years of incarceration

There are many other factors that may be considered when a court is preparing to make a conviction, including the presence of a child in the car or the situation surrounding the charges.
