Multitude of DWI cases in NC erroneously dismissed

A jarring number of DWI cases have been dismissed over the years in several North Carolina counties for insufficient reasons, local news program WNCN reported on September 29.

Although the state average for DWI dismissals is 21%, in Vance, Granville, Lee and Harnett counties, this rate reaches as high as 50% of all DWI cases. North Carolina Administrative Office of the Courts director Judge John Smith said this situation is a red flag that warrants investigative action.

Vernon Stewart, the district attorney for the Lee and Harnett counties, said in an emailed statement that the dismissal rates are indeed too high and that his team will work to lower these numbers. Stewart stated that staffing issues and overworked police contribute to high dismissal rates; when a police officer cannot make a trial, the case may be dismissed. Similarly, the court does not have the manpower to try all of the DWI cases that come through.
