Gaston County DWI dismissals shockingly high

Over 500 out of 1,766 driving while impaired cases were dismissed by Gaston County prosecutors during 2011 to 2012, according to released statistics from the North Carolina Administrative Offices.

Some say the problem is mostly procedural. According to Gaston County District Attorney Locke Bell, delays may occur when a person arrested for DWI, refuses to take a breathalyzer and instead submits to a blood examination.  The state lab in Raleigh, where blood results are analyzed, “is so backed up that we’re not getting the results back for a year to a year and a half.”

Bell, along with local lawmakers, drafted a bill that requires the testing of blood samples involved in DWI cases to be done within the county with the hopes of speeding up investigation processes.
