The Truth About Breathalyzer Accuracy

Many people are arrested on DWI charges because of evidence submitted from breathalyzer tests. However, these tests can often prove unreliable and may point to illegal intoxication levels when a person is actually under the 0.08 BAC limit. As a result, many defendants may be able to challenge these results in their defense case.

If you or someone you love has been charged with DWI allegations, there may be a way to get breathalyzer evidence removed from your case or get charges dropped altogether. For a free consultation with an experienced defense attorney, contact Raleigh DWI lawyer Jim Black today by calling 919-821-2122.

Breathalyzer Facts

#1: Breathalyzers don’t always discriminate consumed alcohol from natural bodily alcohol.

The human body can produce alcohol compounds naturally that mirror those measured by a breathalyzer test. These forms of alcohol are commonly found in the mouth of certain cancer survivors and people with diabetes.

#2: Breathalyzers malfunction.

While police use these test results as evidence, there are many problems with breathalyzer machines themselves. The machines are often off in their measurements because of calibration errors or other mechanical issues.

#3: Breathalyzers aren’t as accurate as other tests.

Blood tests, unlike breathalyzer tests, offer a more direct measure of alcohol intoxication and have stringent requirements. Although many law enforcement figures believe that breathalyzers are relatively accurate, a reading that is close to the legal limit can be challenged
