Physical Control and DWI

In some cases, an intoxicated person may be aware that he or she is unfit to drive and might accordingly choose not to do so. As a result, they may decide to fall asleep in their vehicle for a short period of time to allow their body to process the alcohol in their system. While this is one way to avoid getting on the road while intoxicated, it may not save a driver from being charged with DWI.

Parked Cars and DWI Charges

A person can be charged with a DWI if they are in physical control over their vehicle. This does not necessarily mean that one must have one’s hands on the steering wheel or foot on the accelerator. Instead, the law often interprets physical control as the ability to operate the motor vehicle. Some of the following factors may play a role in determining physical control:

  • Keys are inserted in the ignition
  • An individual is sitting in the driver’s seat
  • The motor has been engaged
  • The person in question has the keys to the vehicle in his or her hands

Although a person may be using the vehicle only to roll down power windows, the use of the ignition at all might be grounds for a DWI arrest.
