License Suspension Procedures in North Carolina

When a person is arrested and charged with DWI, they will automatically lose their license if they fail or refuse a Breathalyzer test. This license suspension will go on automatically for at least 30 days. How License Suspensions Work

The loss of a driver’s license can interfere with one’s ability to work, attend school, or otherwise complete the most basic of tasks. Bear in mind that this is in addition to any of the other penalties that one might be faced with.

A person needs to follow this procedure to work through the suspension system or to challenge the suspension:

  • Any licenses not collected at the time of arrest must be sent to the authorities
  • Absolutely no driving is permitted without a license
  • A person should collect a written notice of license restoration before they drive again
  • Challenges may be made to a suspension, but these challenges need to be formally filed with the courts
  • A person should expect to pay a $50 restoration fee before getting their license back

A person may not get their license back for a certain period of time depending on the circumstances of their DWI. In some cases, the automatic 30-day license suspension may be replaced by a significantly tougher suspension.
