Sentencing Options in North Carolina

A judge may use several different punishments to address a convicted individual in a DWI case, such as jail time combined with punitive fees. These penalty levels vary according to the circumstances of the DWI case, with lower levels having harsher consequences than higher numbers. In North Carolina, the following levels may yield the following punishments:

  • Level 5 – between 1 to 60 days in jail with a fine under $200
  • Level 4 – between 2 to 120 days in jail with a fine under $500
  • Level 3 – between 3 days to 6 months in jail with a fine under $1,000
  • Level 2 – between 7 days to 1 year in jail with a fine under $2,000
  • Level 1 – between 30 days to 2 years in jail with a fine under $4,000

Additionally, a court may choose to combine some of these penalties with other repercussions, including required community service.
